Divorce is like a large cloud. The cloud’s raindrops are all the issues inside of a divorce. Each raindrop has a mound of laws that guide courts in entering orders within a divorce. These issues include:
- Child custody;
- Child placement;
- Child support;
- Spousal maintenance (commonly referred to as alimony); and
- Property division (retirement plans, marital home disputes, etc.)
Within each issue listed above, there are nuances under Wisconsin law that can affect the outcome of each issue. Issues that seem clear-cut typically are not. For example, courts use income to determine a child support amount, but should bonuses be included as income? What about side jobs? How about overtime? If someone owns a business, is their income what their taxes say? Or have they included some living expenses as tax deductions that should be added to their income (vehicle, cell phone, etc.)?
Similarly, entering a child custody or placement order requires the court to balance over 13 different factors. Which are the most important to the court? Which will be the most persuasive in your case?
While Google is a helpful resource for people going through a divorce, try not to take its word as biblical. Google does not know your circumstances, it does not know how your local judges are likely to rule on issues. Most importantly, Google does not know what matters to you the most. Only you and your attorney will.
